WASHINGTON -- The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

CNSNews.com) – U.S. Appeals Court Judge Sonia Sotomayor, mentioned as a possible Supreme Court nominee, voted to deny a racial discrimination claim in a 2008 decision. She dismissed the case in a one-paragraph statement that, in the opinion of one dissenting judge, ignored the evidence and did not even address the constitutional issues raised by the case.

The case, Ricci v. DeStefano, involved a group of 19 white firefighters and one Hispanic firefighter who filed suit in 2003 claiming that the city of New Haven, Conn., engaged in racial discrimination when it threw out the results of two promotion tests because none of the city’s black applicants had passed the tests.

I could get my hand slapped for what I gonna say, but I'm going to anyway.

I tired of people whining about not passing a test b/c it wasn't fair, rather than they weren't smart enough to pass it, when plenty of others did. Honestly, the standards have been lowered so that minorities can get jobs that they're not qualified for - AND THAT INCLUDES WOMEN !!! Standards have been lowered so women can be policemen and firemen, etc. Duh...does a 200 lb. man really want a 100 lb. woman trying to carry him out of a burning building? (Yes, I've said this before, but it's still true). Can a woman wear all that heavy equipment and "tote" all that heavy equipment around like a man? I know in this case it referred to blacks and other minorities, but I always get mad when the whining begins.

"Boo Hoo - the test wasn't fair" - not that the one who took the test wasn't smart enough to pass it.

In June 2008, Sotomayor was part of a 7-6 majority that denied a rehearing of the case by the full court. She wasn't the only justice in the ruling, so why the misleading title to your thread?

I'm going way out on a limb here, but I think it has something to do with her being the only one that is being nominated as a SC justice.....

According to the SC she (and the other 6 chowder heads) were NOT upholding federal law, thus the overturning of their decision.

yup, i always thought we were all one class of people. i didnt know there were protected classes and unprotected classes. i guess this explains a lotof the idiocy of laws these days.
