Andre Smith update

I wonder if that family member is a resident of the state of Alabama, and I also wonder if the transaction in question took place within the state's jurisdiction.

If so, there may be an opportunity to collect the skin of a scumbag under the Alabama Uniform Athlete Agents Act.

It's reasonable conjecture, but I'm pretty sure the family member didn't just wake up on Christmas Day and say to himself, "I think I'll call a sports agent and take out an insurance policy on Andre."

Someone else initiated that transaction, and it can't be legal under AUAAA.

I kinda hope he does go there if they hire New England VP Pioli as GM and McDaniels (NE's OC) as head coach. I think if that happens, they'll pay Cassell huge money to make him the franchise QB. They already have a gamebreaking WR and solid tailback. Draft Andre at #1, draft another offensive linemen with the Dallas pick...be very explosive on offense in a poor division.
If Tom Brady's still got that scar tissue on his knee, Cassel's not going anywhere.

The fact remains that CNS had the cajones to suspend one of our best and most visible players before an important game.

Just as Coach Bryant did with Joe Namath late in the 1963 season, he has sent a message to the rest of the team which will (hopefully) prevent future occurrences of this sort.
Not to say that CNS doesn't have cajones, but from what Bayou has posted this doesn't sound like a judgment call that CNS could go either way on. For the sake of the program he probably had no choice but to pull Andre out of the game.

This whole thing is most unfortunate for everyone concerned -- Bama, Andre, Coach Saban. It is sad that Andre's career at Alabama has to end like this.

I thought it was illegal in Alabama for agents to have contact, directly or indirectly, with a player while still eligible and has not officially signed up for the draft. Can anyone confirm this or straighten me out on this?

Per the Alabama Uniform Athlete Agents Act:

§8-26A-14. Prohibited conduct.

(a) An athlete agent, with the intent to induce a student-athlete to enter into an agency contract, may not do any of the following:

(1) Give any materially false or misleading information or make a materially false promise or representation.

(2) Furnish, directly or indirectly, anything of value to a student-athlete before the student-athlete enters into the agency contract.

(3) Furnish, directly or indirectly, anything of value to any individual other than the student-athlete or another registered athlete agent.

Not try to stray far off topic, but New England is kinda between a rock and a hard place with Cassell because his contract is up. They don't want to use the franchise tag on him because that would be a ridiculous payout and they can't offer him a longterm contract like what the market is willing to give him either. They can't franchise him then trade him if Brady looks recovered due to NFL rules.

I think they have to decide between Brady or Cassell, and no franchise is going to cut their Tom Brady or Peyton Manning for the backup who had a good year while he's injured. The Patriots would be the only front offices with the cajones for that...and I don't think they'll even do it.

There are a few teams you never want to play for in the Nfl. Detroit being one of them, the raiders at this moment are another. Detroit is in bad shape with all sorts of changes going on.If I had the opportunity I'd go some place warm that has an up and coming program say Atlanta.Maybe they can trade up????... Otherwise there is no way Id ever go to Detroit.He'll wind up being like Chris Samuels , never playing for anything.

To answer the questions about emergency action by the NCAA, they don't do that. Even in the cases where there has been reinstatement - and this would certainly qualify, if Andre' were interested in playing another year - the answer comes down in weeks or months, not days...

Detroit might be better served going with the QB route. Likely destination will be St.Louis to replace O.Pace, he is almost done. Cincy, they definitely need OL help. KC might look to bolster their OL if they make a commitment to thigpen. Seattle's decision depends on W.Jones and I think he is locked up for several more years, although he cant stay healthy. doubt he slides past Cincy's pick at #6.

IF it is true that it was a relative and NOT Andre then I feel better about the situation.

Either way, my best to Andre and ROLL TIDE in the Sugar Bowl!

Good. Maybe they can prosecute based on this. Has this law ever been tested in court??

I went and read the law and if he violated the rules as listed above it's a Class C Felony which means between 1 and 10 years in prison, a fine of up to $5k from the state PLUS a fine of up to $25K from the Secretary of State's office that governs agents...

Throw the book at this idiot. Make an example of him!!

I'm wondering the same thing. I would love to see this tested and somebody be made an example of. Then this sort of thing might -- might -- start going away to a degree (I realize it will never completely go away).

Tough break for Andre and the team. As someone stated earlier on another thread, we were this close to going an entire season with no off-the-field drama.

I still have a hard time understanding how a student athlete can be penalized (or his school) if he had no knowledge of this action! THIS IS TOTALLY UNFAIR!!

That is my take also. In this mornings H'ville Times they reported (I forget his name) one of our players had talked to Andre and he (Andre) seemed dazed, or surpirsed, by the whole thing. So, what Bayou revealed makes perfect sense to me.

Im still not sure why we arent playing dumb.... " I dont know where Andre is, otherwise I would let you talk to him" or " insurance policy? uh what insurance policy" or "Andre who". Any of those would work,worked for usc.

This contact stuff with agents need to be overhauled by the NCAA, but where do you draw the line, I suppose. Maybe let the University be able to take out insurance on these kids so this doesn't happen again in the future...

What has Andre & the University of Alabama done wrong in this situation?

It seems unfair with all these sharks surrounding these players, and when there is this much money involved there will always be people messing with these kids. Seems even their own family will do them in for money.........

Exactly, all of this improper contact would stop if you held the agents accountable instead of the players.
