Trump signs executive order prohibiting 'third-party, pay-for-play payments' to athletes

President Donald Trump signed an executive order Thursday aimed at protecting "student-athletes and collegiate athletic scholarships and opportunities" while prohibiting "third-party, pay-for-play payments" to those athletes. The Fact Sheet of Trump's EO reflects a push that is effectively in lockstep with the goals established by the College Sports Commission's name, image and likeness clearinghouse.

Of note, the prohibition of third-party payments does not extend to "fair-market-value compensation" so long as that party has a legitimate business interest. Put another way, the executive order does not target brand endorsements with local and national companies, for instance.
I would have put this on the football board, but it almost certainly would have devolved into political discussion and gotten scrubbed or moved. I figure beat the rush and put it where it was bound to end up anyway.

Should we give Epstein credit for fixing NIL?
Good one.

While I don't disagree with the ostensible intent (I think the real intent is to divert the public's attention from the Epstein file to pay-for-play), it's so vague on market value as to be unenforceable. What is MV? Who decides? And does MV matter anyway?

If a booster is willing to freely give a gazillion dollars of his own money to a HS football player for turning on the booster's sprinkler system every day, who's to say the booster can't do that?

The Collegiate Sports Commission (CSC) has the same problem. I've never understood the legal distinction between them and the NCAA. As in, how is it that the NCAA's rules are null and void, but the CSC's are wholly enforceable? I need some education on that.

Seeing how the booster has a "smart" sprinkler system, all the recruit has to do is say to his iPhone, "Alexa, turn on the sprinkler". I know that would be a major inconvenience for the young lad, but it would be a beneficial life experience teaching responsibility and the value of a hard work ethic. That's what a college sports scholarship is all about.

He fired off another Roman candle to draw attention to himself and sign something that will not do a damn thing except allow him to claim he fixed something.

He’s probably going to sign an executive order ending WW2 in the next few weeks. He’ll go to Missouri and perch in front of the Arch, saying he liked the battleship in “Under Siege” and how hot Erica Eleniak looked coming out of that cake. Then he’ll point across the river to Illinois, where the great Alphonse Capone was the second most investigated person ever, followed by “Trump’s Greatest Riffs” of grievances.

He will then sign the EO, saying he could have negotiated an end to the war in an hour, followed by whatever he might recall from “Patton.” Faux News will run with it with the headline. “Trump Ends World War”, followed by a call for him to win the Nobel peace prize.

Be honest, what gnaws at you as I say this is the fact that as preposterous as what I just wrote is, you can 100% imagine it happening and not even flinch.

NOTHING DJT says or does surprises me anymore. There is no "bottom of the barrel" -- ethically speaking -- to him. My only hope is that we have survived dishonest presidents before and will this one, although it may take decades to fully recover. What I really fear is that in 4 years he will "appoint" Don, Jr., to be his successor...at which time we will have a "kingship" fully entrenched.

That's the thing.

Yes, Trump was over-the-top and a bunch of other things in his first term. But it wasn't until he went Full Moron over losing the election that he proved what had been suggested or whispered: he will NOT follow the rules or the law, they do NOT apply to him. The moments from Election Day through January 6 prove conclusively he would do ANYTHING he thought would keep him in power.

At that point, it is no longer Trump Derangement Syndrome. It is Trump Did-It Syndrome.

I really expected one forbidding high tides. Oh, wait, I think an English king tried that, just to demonstrate the limits of his powers...
