the tennessean at www. tennessean.com has the story of mcdaniel, important lineman accused of assault on a fellow student, with the student suffering 4 broken bones in his face being offered a plea bargain, and accepting surprisingly, a misdemeaner in a knoxville courtroom and placed on probation with a lot of community service. and then fulmer excusing mcdaniels from the all important first two games of the season, and placing him on probation the rest his career at tenn. him and bowden think a lot alike. i am sure the victim thinks that justice has been done.

if the mcdaniels kid has no prior record, then the plea down and probation are not very unusual. remember, if he does not keep the peace and be on good behavior during the probationary period, then the judge will revoke the probation and jail him.

phatty's handling of the situation, however, is another matter. this kind of violence deserves a full season suspension.

also, the victim has a strong personal injury case against the player that may be fruitful if this kid is good enough to play in the nfl.

If...

the university (or booster) pays the damages for the player's act, there's no doubt that it constitutes an "extra benefit" under NCAA rule interpretations. If my memory serves (not a given at my age) the case of the school paying for traffic fines, etc., has already been decided. I don't see any meaningful distinction between settling civil damages and paying a fine for a student...

How do you "unintentionally" hit someone in the face with your fist, when your intent was so obvious. The only thing that was "unintended", was that he was caught on tape, & I have no doubt the utters will " make this right with Mr. Goodrich".

Hey Earle , that in now means that some boosters has agreed to a big payout to this kid as soon as McDanial graduates, which very well could be the case. Then again considering all of UT's free passes with the NCAA, they might feel emboldened enough to pay the kid right now, and never even worry that its an extra benefit, and could "bring them down".
