BIRMINGHAM, Ala. -- An Alabama football booster who won $5 million in a slander lawsuit against the NCAA has given up collecting the money and will instead push for a new trial.


A lawyer for Ray Keller said Monday the Alabama timber dealer is now seeking a second trial.


A jury in Scottsboro awarded Keller $5 million in 2007. He accused the NCAA of slandering him in its investigation of Crimson Tide football in 2002.


A judge threw out the verdict and Keller appealed. But he has now dropped the appeal, and lawyer Don Word said Keller hopes for a second trial in Jackson County. Word said it's possible jurors could award Keller more money in a retrial.

My prediction: This post will elicit a number of "let it go", "it's over and done with" responses. :)

However, IMO, if this individual was wronged, he has the right to seek recourse. I wish him success.

Oh I agree with you. If it were me, I would fight on too, and I hope he does well.

Unfortunately, I'll be honest... he might get another big jury verdict, but it's probably going to go the way of his last one the minute it reaches the appellate court.

INO, any judge, who over turns a jry verdict should be disbarred, and then taken in a small alley behind the courthouse, and stomped.

I think it's just a no-win situation.

Just about any appellate court out there is going to look at this and say this is a ridiculously biased jury pool that would find in Keller's favor regardless of the merits of the case.

I'm not saying I agree or disagree with that -- though in all fairness, there probably is at least a grain of truth in it -- but in reality that is what he is going up against, and it's going to be a very tough battle. Again, the jury is the easy part.

I would do what he's doing in a second. It's the principle of the matter with Keller. He's got the money to fight it, it's not about the money; it's about his personal integrity. That can't be bought and he wants it back.

Unfortunately, there were other people who lost their fight with the NCAA over issues during this same period of time; two of them were without work for several years. I know them well.

Then Logan Young, who was guilty of just loving The Crimson Tide, died a brutal death and a young attorney in Memphis was almost beaten to death and his files related to the NCAA investigation of Alabama were mysteriously stolen. Young's death was ruled "natural causes" and the attorney was claimed to have been robbed at 7:00 a.m. and the only thing taken; the files. Very mysterious, indeed.

I say go for it.....somebody needs to win in all of this. He just needs to look over his shoulder the entire time.

Some people will go to extremes to win. I believe the "Memphis Mafia" have proven that with everything that went on related to the NCAA case against Alabama in the 90's. It was very nasty, much nastier than some people will ever know.
