I followed the press conference on Twitter. At the beginning, I thought it was just a girl smearing Winston. As Meggs continued to run his mouth, it became clear - this was a pathetic prosecution job.

I looked through the report quickly, but it appears that the drug tests were done on the victims' urine and not the blood. If I was the girls' attorney I would ask that the blood be tested. I know the DOT urine drug tests look for specific drugs, not all drugs. I am not sure about their testing. Also, bruising was noted and there was some presence of blood on her clothing. I just hope the Heisman voters read the report and come to their on conclusions.

I think most of you wanted to happen to him without knowing anything about him but just because he chose a different school. .1 is like having two beers, hardly enough to not be aware of one's actions. If she didn't know him then why did she go to his apartment after having sex with someone else?

I'm pretty disgusted to be a college football fan today. I don't know that Winston is guilty, but nothing that I have heard thus far leads me to believe he was innocent. He deserved his day in court, he deserved a chance to clear himself, and we all know that if he wasn't convicted, he'd have been given his chance to go to the NFL and earn millions, and like Ray Lewis, everyone would forget there even was a case.

The victim? She had to wait a year, inexplicably, have her name dragged through the mud by idle speculation (even in this thread), despite physical evidence, despite being clear that she was raped. This is how we treat rape victims, because after all he's a big shot college football player and she's just an alleged victim.

So you know for sure that's how it happened? She had sex, and then went to his apartment to have sex again? Or are you speculating?

Let us be clear on this. It doesn't matter of a woman is naked in a room with a stranger. Rape is rape, there is always the right to consent, or deny consent.

It is worse - he is expecting her to remember it almost one year later. I suspect that she remembered it very well when she first went to the police.

If she was attacked and violated, then I would suspect she would have at least some level of PTSD which affects memory to varying degrees.

No. The reason most of us wanted to see a charge brought against him is the fact that any normal person would be arrested. Instead, this was swept under he rug for a year. Then, a pathetic job by a Florida prosecutor leads to this embarrassment.

Who says that her attorney is not smearing Jameis? You are assuming her attorney is honest and wouldn't slant the story in her favor.

Other than saying that the "incident" was rape, what has her attorney said that could possbily be construed as smearing Winston? If there was someting else, I completely missed it.

Thanks for lumping "most" of us together with your post. I never wish a rape charge on anyone, not an AU player, not a Tenn player or FSU player. Heck Jameis is from the state of Alabama (as I'm sure you're aware since your location says Hueytown), so right away I hate to see it. Things just seem really fishy from the beginning with the TPD, now you have Meggs yucking it up like we're discussing a jaywalking ticket. Just a sad situation all the way around.

Does this completely end it or could the state bring in someone higher up to try it similar to what happened in the Zimmerman case?

in some states, like VA, there is no statute of limitations on a felony. so, here, he could be charged 20 years from now.

You have people actively seeking employment with FSU, refusing to go and collect DNA from Winston. I can't fathom why some people here don't get the outrage.

and the prosecutor again states, "We have a duty as prosecutors to only file ... charges if we have a reasonable likelihood of a conviction."

this is NOT the standard for charging someone...the standard is probable cause, which is a long way from a reasonable likelihood of conviction.

it's pretty obvious that mr. meggs chose to adopt a standard for this case that is much more stringent than the actual burden required to charge someone.

I have no idea what the evidence is or what happened than night, but this meggs guy is misstating the law as to the standards required to charge someone with a crime.

if it was a dipstick test, they are soooo unreliable. a year or so ago I had a client who was brought in for review of her case...she was drug tested and failed. she demanded a new test...and failed. she protested again and the judge told her, I will give you one more and if you fail, I will also issue a bench warrant for perjury. the probation officer then told the judge, "I will even use a stick from a different batch." guess what, she tested negative 3 times from the new batch. the judge was flabbergasted, rolled back in his chair and said, "god, how many people have I sent to jail in the past because of a bad dipstick?" he was mortified.

honestly, I can't believe no one has called him out on this. if this has been the standard he's applied his whole career heaven knows how many criminals have walked because of it.

again, I don't know what happened in this case, but that standard is baloney.
