This description by a FSU professor of the football culture at FSU is a real surprise for me. I can't believe this type of behavior would be commonplace at SEC schools, in fact I think it would be very rare. Does anyone know if this type of stuff (intimidation of professors, out of control student athletes and handlers) occurs anywhere else these days? Granted, the article does seem to indicate there are many student athletes that are genuinely good students and decent human beings, but some of the statements are disturbing. Anyone heard any of this before, could it be untrue?
I have heard similar allegations at several schools - TN and NC come to mind immediately.

It's not going to be the medical professionals job to state "rape" or "not rape". My wife works in the medical field, her job is to do the test, not decipher what she has found, although many times she can, it's not her job or what she's paid to do. This would put the nurses/Dr's in a bad spot legally to make that statement. I'm sure there is a qualified official that will review the examination findings, and make a declaration based on what they see from the records of the exam.
I poorly worded that. I don't mean the nurse or doctor will immediately say "rape" or "no rape."

Is there enough evidence to arrest JW?
If so, what is the likely time frame?
If he is arrested, will he be suspended from the team?
If JW is arrested while there are still games to play, how will FSU do the rest of the season?

I'm not sure what you are saying here, but (4) under the statute deals with being drugged, etc. and it is a life felony. The (5) which I quoted is a 2nd degree felony.

I may be totally confused as to what you are referring to.
If the girl was drugged or too hammered to say "no" or remember if she said "yes" or "no," how would section 5 of the code come into play?

I just read section 4 and see it would be the part of the law that comes into play.

From a sports perspective, probably. We have no way of answering the first two questions. The 3rd is a YES. The 4th - we will have to wait and see.

If so, what is the likely time frame? All in the State Attorney's office. could be hours, could be never. Got to expect an announcement in the next week though.
If he is arrested, will he be suspended from the team? Yes
If JW is arrested while there are still games to play, how will FSU do the rest of the season? Will still be in the NC game. From there, who knows...

When it comes down to it, the prosecutor will choose not to charge the suspect only because of his defense team and not because of the lack of evidence.


People have been charged for less in sexual assault cases but rarely do they have a top-tier defense attorney who has had a year head-start on a defense strategy.

Rape kits are normally done by a sexual assault team. SAT are more experienced and better qualified to testify. Regular ER RN's just done cut it when it comes to evidence collecting.

Oh yes, regarding #5, I completely get what you are saying. I believe #5 applies to someone who isn't completely incapacitated. As an example, my college roommate was on a date and they got really drunk. He took her to his dorm room and they started fooling around and when he tried to go all the way, she said NO and tried to push him off but he proceeded to take advantage of her. She remembered this vividly but was still drunk. I believe she was at a minimum, under Alabama law, a victim of sexual misconduct and may even pass the element test for sexual abuse 1st.

Anyway, I guess the point I am trying to make is that even though she was highly intoxicated, she could have said NO and remembered saying NO and #5 could apply. (Winston accuser.)

This is getting stranger and stranger. At first I thought this was a minor distraction, and now it looks like big trouble for JW. Also if he has hired a top legal team and had them for over a year, who is paying for that? Does his family have that kind of money?

Only a medical professional can do what a rape kit requires in regards to an internal investigation. The investigators will collect fibers, fingernail scrapings, etc. but they DO NOT go inside a woman's "v" unless they are also a medical professional. Sorry, you are 100% incorrect there. This I know for a fact.

Go back and read the statement from the parents about 4 or 5 pages ago. She was not intoxicated as had been speculation on here.

This is what happens when lawyers meet engineers................just ask any of my lawyer buddies.

Actually, one in particular, is almost as weird as any engineer I have worked with.

Yes; especially regarding child abuse.
We're having that in this crazy case up near Charlotte, where an 11-year-old was found handcuffed to his front porch in 25-degree weather, with a dead chicken tied to his neck. Mom wasn't in the house at the time but was charged with being complicit. Of course, the fact that she supervises a team of child-abuse investigators probably didn't help her standing.
