There is a ongoing murder case that my family is heavily invested in (on the victim side). And there apparently has been an appeal filed and the case is moving to the appeals court of Maryland. There hasn't been a trial yet so just curious if anyone would have any idea what appeal could have been filed. I did a bit of googling but that only gets you so far. Best guess is either he confessed to someone or he was found incompetent to stand trial and the appeal is related to one of those? (we know a competency test was ordered)

Some people have tried to replace their doctor with Google and gotten terrible results. I would imagine trying to replace one's lawyer with Google would have similar results. :D

How can there be an appeal with no trial? Is it an appeal as to his competence to stand trial? The appeal should be a matter of record with the clerk of that court

That's what we are trying to find out.

We got a text that the case was closed because we follow the prisoner. Looked it up through Maryland case search and it looks like there was some sort of appeal that is going to ACM which apparently is the Appeals Court of Maryland. There is also some sort of filing to restrict some of the information I believe. So far all we were told is that an appeal has been filed when we contacted the detective.

Again, google told me that there are rare situations where a defendant can appeal before a trial. 2 examples I found were if he is found incompetent, and we know they did order a competency test(he's absolutely nuts at this point based on what we know) OR if he maybe confessed or if there is some sort of issue with a piece of evidence. But again that is just through googling so not ultrareliable. We also have not seen any record or been told by anyone that he was found incompetent to stand trial but it would be seriously unsurprising if he has been or will be.

100000% agreed lol. Its a bigger case and we have a lawyer but for a different issue than the criminal aspect. It's a long long long tragic story.

Just off the top of my head, it appears he was found incompetent and, maybe, in MD, the state can appeal that finding. It also sounds like the judge sealed the records...

Without a trial to appeal, this is perhaps a pre-trial motion? Maybe defense is challenging the confession, or he was found competent to stand trial and they are challenging that.

I did not use AI for this answer; I used the extensive education I got at the Jack McCoy School for Law & Order.
I never found out exactly what it was. But he must have been found competent to stand trial because the criminal trail was rescheduled to next year. We're still somewhat hopeful that the feds will take over the case because apparently they have an incredibly high conviction rate and only take cases they know they can win. (If this guy is somehow found innocent my entire family seriously might have to move to get far away from him)
