Having read a bit of the Founder's thinking, I would say that the Presidential pardon can only work in favor of the convicted, never to his detriment. (in other words, the president cannot overturn an acquittal.) It is just one last barrier between an accused individual and maliscious prosecution.
I do not imagine that the founders believed it would be used so pervasively and sold in such a corrupt fashion, although they should have. The entire English Whig tradition would've shown them that this was likely to happen. Any power that can be abused will be abused.
And that comes through loud and clear throughout the Constitution. To me, that makes the absolute pardon power all the more puzzling...
 
I draw the analogy between paratroopers versus airmen bailing out from a damage play.
It is legal to shoot paratroopers (soldier deploying to combat) but not airmen (airman parachuting from a disabled aircraft).
These guys strike me as more analogous to the latter category, and are thus protected targets.
The Germans, certainly the SS and maybe even the Wehrmacht, still shot them, as they hung in trees. Most of them were wearing sidearms. I think the U-boat/merchant ship analogy is closer. The attack can be justified, in that the crew members are directly aiding the war effort. Floating, hanging on to debris, that no longer holds water. Even if you accept the administration's equating these drug deliverers as endangering the security of the US (hard to believe the POTUS does, turning around and pardoning a drug kingpin), once the boat's destroyed, there's no logical way they can be called a direct threat to anyone. It's a war crime. Period...
 
I wonder what munitions they used for this attack? It appeared to be 35 or 40' open boat and must of had a large amount of gasoline abord and yet 2 abord 'survived'. :unsure:

Tom Cotton (R-Ark.) said Thursday he was pleased with video footage he had just seen in a classified briefing that showed two survivors of a U.S. military strike on an alleged drug boat being killed in a follow-up strike, an incident that has alarmed lawmakers in both parties and sparked calls for investigations of potential war crimes or outright murder.
These were “righteous strikes,” Cotton, who chairs the Senate Intelligence Committee, told reporters on Capitol Hill. He was one of several lawmakers briefed by Admiral Frank Bradley and Joint Chiefs of Staff Chair Gen. Dan Caine on the Sept. 2 boat strikes in the Caribbean, near Venezuela.
“The first strike, the second strike, and the third and the fourth strike on Sept. 2 were entirely lawful and needful and they were exactly what we would expect our military commanders to do,” he said.
Asked to describe what he saw in the footage of the second boat strike, Cotton chuckled.

“I saw two survivors trying to flip a boat ― loaded with drugs, bound for the United States ― back over, so they could stay in the fight,” he said. “And potentially, given all the context we heard, of other narcoterrorist boats in the area coming to their aid to recover their cargo and recover those narcoterrorists.”

I really, really like this and I hope they remain true to their initial intentions. Having almost everyone "vested" in how the stock market and the economy, in general, is doing is a positive thing. This might help people understand that it's not always what you do today or tomorrow, but how you are consistent and engaged in your own financial dealings that leads to success.
