If he's retiring, I'll walk that part back. Having been a prosecutor (military and state), I think the TPD bears a huge share of the blame by not following normal procedures on this case. But, even if I came to the conclusion that I couldn't get a conviction and thus couldn't take the case to court, I would never let myself become a part of a circus as appears to have happened down there. This is serious stuff for everybody and laughing and joking diminishes everyone, except perhaps the victim.

And before we throw stones at Tallahassee, this can happen ANYWHERE the accused is popular, famous, etc.

Heisman candidate.

A good journalist would make a compelling story out of this, especially if they do their digging into Winston's past. The sad thing is, this will end up making college football look worse. Penn St. reminded us, and this case shows that rape is different if it happened in a college football town...

Re: The Penn State story. I wanted to believe in Paterno as a great man so much that I let that personal bias cloud my initial thoughts regarding his culpability. After all that happened at Penn State, I hoped (naively) that sexual perpetrators would no longer be covered for. To see the jovial manner of that DA at the press conference is truly sickening.

Nope. Difference = (.08 - .1)/.08 = .02/.08 = .25 or 25%

I am so proud of myself, for the first time ever I actually put something in simpler terms than other posters!

Just because it can happen anywhere doesn't mean Tallahassee doesn't deserve to have some stones thrown its way.

I read through the report and I'm sorry but, you don't find traces of blood and bruising if the sex was consensual. I'm no lawyer but, reading that stuff, there was plenty of evidence to let a jury decided IMO. I really feel bad for the victim and her family, they just found out first hand how much football is above the law in this country.

The word "integrity" appears twice in the Heisman Trust Mission Statement and if they give the award to Winston then I think it demands that they rewrite there mission statement.

Am I to understand that they didn't screen for flunitrazepam (or such) after hearing her story? Seriously?
 
To clarify my comments, yes they are broad brushed and extreme. It was made to make a point. Again, no one knows all the facts except for Jameis and the witnesses if there were witnesses. You can take either her attorneys comments which show that they weren't completely honest or you can take Jameis'attorneys comments as honest though we know their are inconsistencies there also. So for someone to pick sides is silly since we don't know what really happened.
I have stayed many times that if Jameis did this then he should be punished. If he didn't, she should be. I'm just not going to call someone a rapist when I don't know. If it makes you feel good to call someone that when you don't know all the facts then so be it.
I know of a case personally, where a friend of mine was accused of rape in high school. No one ever would believe she lied because she was thought to be such a sweet girl. Got months of hell for my friend only to find out she lied. Everybody just knew he was guilty. Had death threats. Then you look at the Duke lacrosse situation. Everybody knew that they were guilty. Now, she maybe telling the truth. I'm not going to disrespect her because I don't know the truth. I'm just starting that you also don't know the truth and are just assuming if you are going to call him a rapist. One thing we all can agree on is the police department was derelict.
 
After seeing the smiling faces and giggles in that press conference, if I understand all the facts correctly, I would advise the victim and her family to obtain representation from Gloria Alred asap. The way she has been identified and smeared in social media by FSU students and the inept investigation by TPD should leave her no choice but to clear her name.

FSU bears some responsiblity in this as well. They apparently never did what was required to investigate the allegation. If so, could the victim have a claim against the University itself?

Dang, I guess that why veterans tell these young athletes to stay away from them college girls. Whether he did it or didn't, messing around with that girl got him in a mess.

The thing that separates this case from allegations we've seen in the past (that proved to be false) was the physical evidence. I intend to go over that document completely, but from what I know at this point in time, there was more than enough physical evidence to conclude rape occurred and Winston did it. The reasons for not charging him had nothing to do with this, but rather went to things that as I said before, should have only been of concern to the defense attorney. Priorities got mixed up, and that's why I have such a huge problem with this.

That does not make him guilty, but give me another case in which we had physical evidence in the affirmative, a rape kit, testimony of the alleged victim, etc... and we not only don't move on it, but it takes a year for the PD to even pretend to do their job?

Or you could read the documents which spells out all the evidence collected and draw a conclusion like a jury would. I read it and my conclusion is that he raped her.

I feel your pain MC. I think what people are upset with is that it didn't at least go to trial when in most people's opinions there was enough evidence there to at least put it in front of a jury. You're right, we really do not know what happened. But how the thing was handled just has the smell of cover up all over it.

I don't think anyone is claiming he's guilty, but many / most are ticked as this should be settled in a court of law. As several here have mentioned repeatedly, if it were any of us rather than Winston, the trial would already have started.
