This bit of news makes me feel a little better. I will take it as fact since it is coming from the all-seeing eye of Sauron.. I mean Bayou. :)

The one thing that still stands out to me is that after 15 yrs of recovering from the Langham issue, why would anyone associated with Bama, player or family, ever ever do anything as far as illegal contact with agents ever again. The Langham stupidity started the whole process that eventually ended with Means and us damn near getting the death penalty. Im glad AS wasn't directly involved but how could his family, or anyone else's, be that completely stupid?

I'm begging all Bama fans, players' families, and players to please immediately beat the hell out of any agent seen within 100 feet of anyone associated with our program unless they have already declared for the draft.

Im still not sure why we arent playing dumb.... " I dont know where Andre is, otherwise I would let you talk to him" or " insurance policy? uh what insurance policy" or "Andre who". Any of those would work,worked for usc.
The ncaa doesn't have the same gusto for prosecuting other big-name teams like USC as they do for Bama. CNS did the right thing - we should play this hand straight up and do things the legal and proper way.

Here's another question you might want to ask yourself. How can this type of insurance policy be taken out without the player's knowledge. The short answer is that it can't.

My father has written several of these type policies for Alabama athletes. Among other things, it requires a full physical. The institution would also be contacted and interviewed by underwriters before any policy would be issued. And, finally, the insurance company is keenly aware of the NCAA rules governering these types of policies.

By the way, I believe a proposed insured (in this case, Andre) must sign an application for insurance even if the resulting policy will be owned and paid for by another.

As there's no way to prove that the student athlete had no knowledge, the rule errs on the side of caution; it would be too easy to game the system otherwise.

IF it is true that it was a relative and NOT Andre then I feel better about the situation.
There has to be some contact, directly or indirectly, with the agent by the player.
Directly- the player talks with an agent and gets something of value.
Indirectly- the player has a third party to contact an agent and get something of value.

Just a member of a family talking with an agent is not a violation of the NCAA rules.
There is more to this than just an uncle getting something from an agent. The player must have knowledge or precieved knowledge and fail to report the incident.
I believe the phone records is the key!

How many times per day will I have to post that the % of unfavorable NCAA action is just about exactly zero? All that is required is prompt action by the institution upon discovering the situation and we have complied with that. BTW, knowledge by the student-athlete is not mentioned in the relevant NCAA bylaw:

5. An individual shall be ineligible per 12.3.1 if
he or she (or his or her relatives or friends)
accepts transportation or other benefits (cash
payments, free meals, tickets, etc) from:

a. Any person who represents any individual
in the marketing of his or her athletics ability.
The receipt of such expenses constitutes compensation
based on athletics skill and is an extra
benefit not available to the student-body in
general; or

b. An agent, even if the agent has indicated
that he or she has no interest in representing
the student-athlete in the marketing of his or
her athletics ability or reputation and does not
represent individuals in the student-athlete’s
sport. [NCAA Bylaw 12.3.1.2]

Yeah, I saw your post pop up at about the same time as mine. Dad gave me a lot more info, which I'm sure you already are aware of, but I just tried to post the most applicable part. Since he has been down this road with Alabama athletes several times, he was pretty skeptical of the whole scenerio in as far as AS not knowing. He said Alabama is extremely diligent in educating all parties involved. He also said the underwriting is a major pain because of all the people they must talk to. He also mentioned that the commission isn't worth the effort. You write the policy as a favor to the athlete and the university, because it's not worth the time and effort otherwise.

I talked to one of our offensive starters parents earlier this morning and his dad told me something I wasn't aware of. The families have to come in and and learn about all the NCAA rules as well as the players. This isn't optional. They are a little in the dark though stories are circulating among them. I won't share any of them because he stressed that they don't know anything for certain, yet. He's sick about it. His wife amd AS's mom are very close.

I kinda hope he does go there if they hire New England VP Pioli as GM and McDaniels (NE's OC) as head coach. I think if that happens, they'll pay Cassell huge money to make him the franchise QB. They already have a gamebreaking WR and solid tailback. Draft Andre at #1, draft another offensive linemen with the Dallas pick...be very explosive on offense in a poor division.
off topic but detroit needs corners with skill. I'll go further they really need about 7 more defensive players w/ skill lol

Well, I'm not an insurance agent, but I would think that it would be damn near impossible to take out an insurance policy on someone and them not know about it.

As we know, being fair is not a high priority with the NCAA. It's better to lose Andre for this game than to let him play (even if the NCAA said it was OK), and six months from now be "staring down the barrel of a gun". The best thing CNS could do is "nip it in the bud" and take no chances with the NCAA. Last time we tangled with them it's taken several years to get over.

Could this whole thing have been a result of a disgruntled agent 'getting back' at Andre because he(the agent) was not allowed to represent him? That's what it sounds like to me could have happened.

I wish this were true. He followed that up with: "Everyone on our team depends on each other to be responsible, to make good choices and decisions relative to their actions."

Now, if he meant "decisions by relatives and their actions"... :biggrin2:
Guys, he was talking about Andre's decision making being a factor in his suspension. Why add that line about being responsible if Andre had absolutely no part in this? Clearly, some folks--out of their love and respect for Andre--are trying to take all of the blame off his shoulders. There is certainly some blame, otherwise Saban would have worded his statement differently.

I like Andre and hate that this happened, but from what I've heard from a writer who is in NO this very minute--and who text messaged me the news about the suspension well before it was reported (I've saved it with the timestamp if I need to prove it to anyone)--Andre got involved in a situation that he could have avoided. [EDIT: That's all I was told. There was no additional information given, as much as I tried to pry]. This whole "Andre didn't know a thing" bit simply doesn't wash. Let's be honest with ourselves.

You never know, but that scenerio is a very real possibility, imo. Something caused the university to investigate.
