The official position in PA seems to be that Joe is clear of the law. In Alabama, I'm not sure he and the GA would be. It's just a misdemeanor, up to $500 and up to six months...

Just because your actions are legal does not make them right. It is sad that he will go out with this albatross around his neck because it will forever taint his legacy. But it does seem joepa was remiss.

Well, originally I just felt like he thought he was bigger than the PSU program for hanging on at 84. But this takes it to a different level entirely.

I'm troubled but am willing to give JP some time to set the record straight before passing judgement.

Here's my "giving JP the benefit of the doubt" scenario:
In this day and age of billion dollar football, Universities have departments to handle every situation that may arise. I think it's safe to say that coach's are conditioned and trained to follow the chain of command and report incidents to the school and have the administration take the appropriate steps on their or the school's behalf. JP has probably followed this process hundreds if not thousands of times in his tenure. In this situation all of JP's knowledge is hearsay and he probably assumed that the University would hear the first-hand account and take the appropriate action. Call it "I want someone smarter than me to handle this" syndrome. To me there's still a possibility he's guilty of nothing more than naivety and too much faith in his school's leaders. Perhaps he never imagined the University wouldn't do the right thing and he found the incident so troubling he just really didn't want to get involved. The guy is old as Moses and coaching a football team so I think that's a legitimate possibility.

Another piece that I find peculiar is that the graduate assistant did not report the incident to the police. This is the person who had first-hand knowledge of the incident and the article only indicates he reported the incident to JP and the school administration and not the police. Could the University have somehow convinced the GA and JP that they had taken an appropriate action and therefore a follow-up wasn't necessary? Just seems odd that both parties only reported the incident to their superiors and not the authorities.

If his mindset really was to sit on his hands in the hope this would go away then I hope it comes back on him with a vengeance, but I'm reserving judgement till things are a little clearer or at least until he tells his side. Something like this shouldn't be tried in the media.

So outside Paterno’s home Tuesday, reporters clustered around him as he made his way to his car.

“I know you guys have a lot of questions, and I was hoping I would be able to answer them today, but we’ll try to do it soon, as soon as we can,” he said. “Can’t do it today.”

That wasn’t good enough. It is not good enough. Not for those there, not for anyone rightfully wanting answers, not for any right-minded person well aware that protecting children from sexual abuse trumps any football program or football coach. So reporters began shouting questions.

“Guys, Coach has to get out to practice,” a man said. “Out of his way, please!”

I can see the GA, but not Paterno. I mean, he had a moral responsibility, but basically he is hearing information second hand about a possible crime. I don't know that he has any responsibility at that point, at least legally.
Have you looked at the mandatory reporting act - "School teacher or official?" The act doesn't specify what level. Again, I'm talking about Alabama, not PA. Truth to tell, no prosecutor would think about prosecuting Paterno, even if he were in this state, with his idolization...

paterno also testified before the grand jury. He was there and heard the other testimonies. He certainly has been notified of the content of those testimonies. It is available to everyone...and it is disgusting. paterno knew and chose to ignore because he did not want to bring shame to his creation. As for his information being "second hand about a possible crime" he must have trusted the source because he remains on the paterno staff to this very day. So he trusts him on the sideline but doesn't believe his story about sandusky? Seriously? Really?

Together he and his father decide to wait until the next day to tell JP. Why the delay? Then after hearing the gory details, JP decides to wait another day to contact the AD. Then after this, the grad assistant is eventually promoted to assistant coach and recruiting coordinator and has kept his mouth closed about it until summoned by the grand jury. It seems like his silence may have been bought with the advancement of his career. As JP pretty much runs everything football at PSU, if everything that we have heard thus far is true, he was complicit in the over up.

Is he referring to other coaches in the program? This is just sad and pathetic...

I was thinking about that very same thing. I am really wondering if there was not only just some disturbing head turning and inexplicable inaction but some sort of conspiracy to cover up the rape in the shower. Maybe that continued even into the apparent subsequent sexual assaults. I didn't want to bring up that strange possibility since that would start arguments with the Paterno supporters and rightfully so.

I am not going to defend any conspiracy theories but y'all have to admit things in this matter keep getting harder to believe with each passing day.

It's an ugly situation, but much, much worse because so many people tried to cover it up to protect the beloved image of "we are penn state."

I'm not a big fan of Howard Bryant, but I agree with his article on this issue

Maybe I am the last person to see this...but psu fans chanting support outside the paterno home, and Scott Paterno telling reporters "the status quo holds." Nero fiddles as Rome burns.
Like I said, anyone coming to the defense or support of Joe Pa is scum to me so, all those idiots outside his home are the scum of the earth. Scott Pa needs to shut the blank up; the status quo is what kept this a secret for over a decade so, they better consider changing it.

I said this in the other thread but after reading this one I have to say it again. Am I in the twilight zone? Children were molested. A grown man saw another man having anal sex with a little boy and did not immediately go to the aid of the child. What is all this talk about chain of command or Paterno's legacy? Who cares about his legacy? This whole line of thought that he should have retired before and this wouldn't taint his legacy is really perplexing to me. A man's true character shows in how he acts when no one is watching. Well all of those involved have shown us their character.

Here we contact our Administrator and then we go through several more hoops to get this reported. But, basically after I report it to my administrator my role is done.

If the PTB at Penn State didn't already have an exit plan for Joe - one that might be adapted to current conditions - they are dumber than I already thought.
